On September 4, 2020, Governor Newsom signed AB 2257, which significantly revises and attempts to clarify California’s independent contractor laws. AB 2257 became effective immediately upon signing by Governor. Last year, AB 5 adopted the “ABC Test” as the presumptive standard to determine whether independent contractors should be treated as employees of a hiring entity, and it also created a complex list of exceptions. AB 2257 preserves the ABC Test for independent contractor classification and expands the number of exceptions applicable to a wide range of workers, from mimes to competition judges. AB 2257 also modifies the business to business and referral agency exceptions, expands the professional services exception, and creates “single-engagement” business-to-business and music industry and performer exceptions.
